LevelUp is an online coaching platform developed and operated by AS3 A/S, Hasselager Centervej 35, DK-8260 Viby J, Denmark. When you sign up to use LevelUp and its coaching services, you become a LevelUp User. When you pay for access to coaching on LevelUp, you become a LevelUp Customer. The same person or business can be either of or both LevelUp User and LevelUp Customer.
Entering into agreement for LevelUp
LevelUp offers access to coaching on the LevelUp online coaching platform via https://app.lvlp.io. By signing up as a user on LevelUp you enter into agreement as a LevelUp User under terms described in this document, regardless of whether you are also the payer, or another person or organisation is paying on your behalf. If you sign up using your own payment method, you become a LevelUp Customer and enter into agreement under terms described in this document.
On LevelUp you may purchase access to your own personal LevelUp Coach for a 3-, 6- or 12-months cycle. By purchasing a subscription you agree to an initial and recurring subscription fee, renewed by the end of every cycle signed up for and at the then-current subscription rate, and you accept responsibility for all recurring charges until you cancel your subscription. You may cancel your subscription at any time, subject to the terms of our cancellation policy. Once you subscribe, AS3 A/S will automatically process your subscription fee in the next billing cycle. AS3 A/S will continue to automatically process your subscription fee at the end of each billing cycle at the then-current subscription rate, until you cancel your subscription. We explain how to cancel your subscription below at the section "Cancellation policy". Subscriptions may also be cancelled by AS3 A/S under conditions explained in “Cancellation policy” section.
Subscription fees are non-refundable. You may cancel your subscription renewal at any time before you are billed for the next cycle, by logging into your account and following the cancellation procedures under “User settings” or by emailing email@example.com.
If you – or another person or organisation paying for you - cancels your subscription, you will no longer be a LevelUp Customer and loose access to your subscription services. You will remain a LevelUp User until your account is closed. Your account will automatically be closed 60 days after your subscription is cancelled, if it is not re-subscribed. Upon closing, your personal data is automatically deleted within additional 60 days.
If the provided payment method is invalidated or payment cannot be processed, your access to LevelUp will be suspended and you will be given opportunity to revalidate or update your payment method before you will be able to access LevelUp again. If your payment cannot be re-established within 14 days, AS3 A/S will consider this a cancellation of your account following the normal cancellation policy procedures.
AS3 A/S may cancel your subscription at any time within a billing cycle without justification, by sending you a written notification and refunding payments made for the current billing cycle.
Full satisfaction and refund policy
AS3 A/S wants you to be happy with the LevelUp platform and services. If, after 14 days of the initial billing or your first meeting with your coach – whichever occurs first – you are not satisfied with LevelUp, we offer to provide you with a new coach or refund your billed amount. If, upon the first meeting with your second coach, you are still not satisfied, AS3 A/S will refund the initial billing of your subscription. Hereafter AS3 A/S offers no refunds to subscription billings.
Children under the age of 18 years may not use or pay for LevelUp. To stay eligible for use of LevelUp, you must at all times comply with the LevelUp user guidelines.
AS3 A/S respects intellectual property rights and expects you to do the same. We’ve established a few ground rules for you to follow when using the LevelUp. You must follow these rules. The following is not permitted for any reason whatsoever:
Impersonating anyone other than yourself signing up as a LevelUp User or LevelUp Customer
Sharing or handing over your personal login access or password to any other person or using the access information of any other user
Copying, recording or making available to the public any part of LevelUp or its content
Circumventing any technology used by LevelUp to protect access to the LevelUp platform or its content
The use of offensive, abusive, defamatory, pornographic, threatening, or obscene language or material
Any attempt to abuse the LevelUp platform using malware, trojan horses, viruses, social engineering or any other means
Your password protects your user account, and you are solely responsible for keeping your password confidential and secure. You are responsible for all use (including any unauthorized use) of your username and password on LevelUp. If your username or password is lost or stolen, or if you believe there has been unauthorized access to your account by a third party, you must notify us immediately and change your password as soon as possible.
Fair and necessary use
While LevelUp provides unlimited access to resources, features and a personal coach via chat and video meetings, this is limited to fair and necessary use. For resources and features, this means you may not use LevelUp in a way that overloads our connection bandwidth or servers. For access to a personal coach, this means that you and your coach will discuss and settle the amount of interaction that is valuable, fair and necessary during your LevelUp subscription. If you are unhappy with this settlement, you may cancel your subscription following the Cancellation policy. If AS3 A/S believe you are not complying with “Fair and necessary use” they may cancel your subscription following the Cancellation policy.
AS3 A/S is not liable for covering any costs related to loss of data or access to LevelUp. In case of loss of data related to system breakdown or breach of security, we are obliged to inform affected LevelUp User and Customers according to our General Data Protection Policy.
Data Protection Policy (GDPR)
LevelUp is designed for individuals and businesses for effective people development.
In the application you can engage in development acitivities and your personal data is stored encrypted and never visible to other users.
Your data is kept as long as you are subscribing to the LevelUp service.
Your tasks, written reflections, chat messages and the written feedback you receive are yours privately. You may choose to share the contents with others, if you wish to do so. Upon your first login, you get an overview of the specific items you share and must accept these terms before using LevelUp.
LevelUp is developed and operated by AS3 A/S. Your application data is stored and served on Google Firebase cloud-based services in USA only in encrypted format and only accessible to AS3's technicians in compliance with GDPR (Learn about Firebase GDPR compliance here).
Technically LevelUp is designed in way that users cannot access sensitive personal data on a system-wide basis. Only explicitly granted access per user programme and per item provides access to specific users' information. Only few, selected AS3's technicians have system-wide access and only via strong passwords and two-factor authentication.
To ensure our users make best as possible use of the LevelUp platform we also track general usage - sharing no personal data, but only tracking time spent, features used etc. - of app (app.lvlp.io) and website (lvlp.io) using the tracking services of Google Analytics (Learn about Google Analytics GDPR compliance here) and ActiveCampaign (Learn about ActiveCampaign GDPR compliance here).

According to the GDPR (EU General Data Protection Regulation) you have some important rights worth knowing. Please read about them and how we comply:
You have the right to know about the stored personal data on you
To provide this service, we need to store the following data about you:
Your business email address, name and organisational affiliation
Your activities in the application and messaging with other people via the application
In the application, any information that you record is labeled with a note about exactly who you will be sharing the information with. In connection with the administration of LevelUp's application database, AS3's database administrators have access to all data. This access is limited to few people and all access is logged in the application platform log.
You have the right to retrieve the data we store about you
You have the right to retrieve a copy of the data we store about you. We will provide you with a human readable file containing everything if you ask for it. As we are also committed to Data Portability, we will also make sure the file is formatted in a computer readable file.
We cannot support any data format, but consider HTML, object notation and JSON acceptable. Please send an email to firstname.lastname@example.org if you wish to start this process.
You have the right to demand your data deleted by us
You have the right to be forgotten. If you let us know, we will delete all our records of you and anything containing personal information.
NOTE: Of course we can't undo this..

If you have not had any activity in LevelUp in 12 months, your personal information will automatically come up for deletion and you will be notified to log in again to prevent your personal information from automatic deletion.
If we have a data breach, you have a right to know
If we have a breach of our security or even if we think we may be at risk, we are committed to notifying all users via email as soon as possible and within 72 hours.
You may to object to the processing of your data
If you are not satisfied with the way we process your data, you can file a complaint with us.
You are entitled to demand us correct any wrongful information or demand specific parts of your data deleted. You will find our general contact information at on the bottom of this page and you can email us at firstname.lastname@example.org.
Cookies & Tracking Notice

A cookie is a popular term for a small piece of data that is transferred from a website to your browser for record-keeping or similar purposes. Each time your browser visits the same server it will make this information available to the server.
From a user's perspective it is important to know what we track and how you may avoid it.
What we track
Tracking on our site support the following purposes:
We use tracking cookies through Google Analytics and for website performance and analysis.
We use site cookies to enable, facilitate and streamline the functioning of our and app. E.g. to know, if we should display our cookie notification banner.
We use tracking cookies through ActiveCampaign to serve more relevant contents to users and customers. E.g. to avoid advertising a product, you have already purchased or ask you to signup for a newsletter you are already subscribing to.
We use trackers from Facebook, LinkedIn and Google to optimize our campaign effectiveness and be able to serve more relevant contents to you.
We never track or store any of your data related to coaching or other development activities on the LevelUp platform on the above mentioned services. Only browsing data (like pages visited, time spent, features activated, etc.) are tracked.
